In a court filing, the company denied liability, calling the event a “tragic” result of Raine’s “misuse, unauthorized use, unintended use, unforeseeable use, and/or improper use of ChatGPT.” OpenAI pointed to its terms of use that prohibit access by teens without parental consent and specifically ban using ChatGPT for suicide or self-harm purposes. The company argues the family’s claims are blocked by Section 230 of the Communications Decency Act and claims a full reading of the chat history shows ChatGPT directed Raine to suicide hotlines more than 100 times. The lawsuit, filed in August in California’s Superior Court, alleges the tragedy resulted from “deliberate design choices” by OpenAI when launching GPT-4o.

But here’s what I’m wondering: if someone is in that dark of a place, does it matter if an AI occasionally says “call a hotline” while also providing detailed methods and encouraging secrecy?
